These Terms of Sale govern the subscription to folio.fyi Premium (“Premium”), the paid option of folio.fyi. They complement the Terms of Use, which govern the use of the Service in general. Please read them before subscribing: you accept them when you subscribe, by clicking the subscribe button, under which this acceptance is stated.
You can save or print this page at any time. The version you accept remains available at a permanent address, given in your subscription confirmation email.
1. Provider

2. Where you buy Premium: Paddle, Apple or Google
You can subscribe in two ways:
- On the website (monthly or annual plan). Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. You buy from Paddle (Paddle.com Market Limited, United Kingdom, or another Paddle entity depending on your country), and the purchase is also governed by Paddle's Buyer Terms. Paddle processes your payment and issues your receipt or invoice.
- In the app (weekly, monthly or annual plan; the weekly plan exists only in the app). In-app purchases are billed and processed by Apple (App Store) or Google (Google Play), with the payment method of your store account and under the store's terms. The store manages renewals, cancellation and refunds for these purchases.
Whatever the channel, Premium itself, the service you receive, is provided by Hugo Bonnet EI under these Terms of Sale.
4. Prices

Prices include all taxes. For purchases on the website, Paddle calculates and collects the VAT or sales tax that applies in your country, and the final amount is shown before you pay. In the app, prices are set in your store's currency and may differ slightly from the website's because of store price tiers and local taxes.
The price that applies is the one shown when you subscribe. It stays the same at each renewal unless it is changed as described in section 11.
5. Free trial
The annual plan comes with a 7-day free trial, on your first subscription only (one trial per person and per account). The monthly and weekly plans have no free trial. You are not charged during the trial. Before you start it, you are clearly told that your subscription becomes paid at the end of the trial and on which date the first payment will be taken. Unless you cancel before the trial ends, the annual subscription starts automatically at the end of the trial and the first payment is taken then. You can cancel at any time during the trial, in a few clicks, without being charged.
6. Duration and automatic renewal
Premium is subscribed for one week, one month or one year, as you choose, with no commitment beyond the period you pay for. At the end of each period it renews automatically for the same duration, at the price then in force, unless you cancel it before the end of the period (section 8). The renewal date is shown in your account settings and, for purchases in the app, in your store settings.
For annual subscriptions, we send you an email between three months and one month before the renewal date, reminding you that you can choose not to renew and giving the deadline to do so (Article L215-1 of the French Consumer Code).
For purchases in the App Store, payment is charged to your Apple account when you confirm the purchase. The subscription renews automatically unless automatic renewal is turned off at least 24 hours before the end of the current period, and your account is charged for the renewal within the 24 hours before the end of the current period. For Google Play, the rules of Google Play apply.
7. Subscribing and access to Premium
On the website: choose a plan on the Pricing page and sign in to your account. Under the subscribe button, it is stated that by clicking you accept these Terms of Sale and ask for Premium to start immediately (section 9). You then check your order in the Paddle checkout (plan, price including taxes, renewal), and you confirm the payment. In the app: follow the purchase steps of your store.
Premium is activated as soon as the payment is confirmed, or as soon as the free trial starts. You receive a confirmation by email: Paddle's receipt for purchases on the website, your store's receipt for purchases in the app.
8. Cancellation
You can cancel Premium at any time, free of charge:
- Subscribed on the website: in your account settings, with the Cancel my subscription button; it takes a few clicks and you receive a confirmation by email. You can also cancel by writing to us or to Paddle.
- Subscribed in the app: in your device's settings (on iPhone: Settings, then your name, then Subscriptions; on Android: Google Play, then Payments and subscriptions, then Subscriptions). We cannot cancel a store subscription for you.
Cancellation takes effect at the end of the period already paid: you keep Premium until then and you are not charged again. Except in the cases provided for in sections 9, 10, 12, 14 and 15, the period in progress is not refunded.
9. Right of withdrawal
If you are a consumer, you have 14 days from the day you subscribe to withdraw from the contract, without giving any reason and without penalty (Article L221-18 of the French Consumer Code). If your subscription starts with a free trial, you can also withdraw within 14 days of the first payment.
Immediate start. Premium is available as soon as you subscribe. As the law requires, you expressly request that Premium start before the end of the withdrawal period: this request is written under the subscribe button, clicking it makes the request, and it is confirmed in your confirmation email. Because Premium is supplied continuously and is not fully performed within 14 days, you keep your right of withdrawal: if you withdraw, we refund all amounts paid, minus an amount proportional to the period during which Premium was available to you, until you informed us of your withdrawal (Article L221-25 of the French Consumer Code). If your express request was not obtained, nothing is deducted.
How to withdraw. Inform us of your decision before the 14 days expire by any unambiguous statement, for example an email to contact@folio.fyi, or by using the model form below. For purchases on the website, you can also contact Paddle directly. The refund is made within 14 days of receiving your decision, using the same means of payment as for the purchase, at no cost to you (Article L221-24 of the French Consumer Code).
Purchases in the app. Withdrawal and refunds of purchases made through the App Store or Google Play are handled by Apple or Google under their own terms: make your request to the store (for Apple: reportaproblem.apple.com).

10. Refund policy
- Within 14 days of subscribing (withdrawal): refund of the amounts paid, minus the share corresponding to the days of Premium already provided if you had asked for immediate start (section 9).
- Cancellation after 14 days: the period in progress is not refunded; Premium stays active until its end and you are not charged again (section 8).
- Defect of conformity we cannot fix: price reduction, or termination with a refund, as provided by the legal guarantee (section 14).
- Termination by us without any breach on your part, or a change to Premium that you refuse: refund of the unused part of the period, pro rata (sections 12 and 15).
- How to ask: for purchases on the website, write to contact@folio.fyi or contact Paddle through paddle.net; refunds are paid by Paddle to your original means of payment. For purchases in the app, make your request to Apple or Google, whose refund policies apply.
11. Price changes
We may change the price of Premium for future periods. We will inform you by email at least 30 days before the new price applies to you, which will be at your first renewal after that notice. If you do not accept it, you can cancel before that renewal (section 8); otherwise the new price applies from that renewal. For purchases in the app, the store also informs you and may ask for your consent under its own rules. A price change never applies to a period already paid.
12. Changes to Premium and to these Terms
Premium evolves. We may add, improve or modify features for valid reasons: improving the service, adapting to technical or legal changes, or security. These changes come at no extra cost to you.
If a change would have a more than minor negative impact on your access to Premium or on your use of it, we will inform you clearly, by email, reasonably in advance and with the date of the change. You may then terminate your subscription free of charge within 30 days of that information or of the change, whichever is later, and we refund the unused part of the period already paid (Article L224-25-26 of the French Consumer Code).
We may also change these Terms of Sale. The version that applies to your subscription is the one you accepted; a new version applies to you from your first renewal after we have informed you of it by email at least 30 days in advance, and you may cancel before then if you do not accept it.
13. End of your subscription
When your subscription ends, whatever the reason, your account returns to the free version of folio.fyi. Nothing is deleted and your whole portfolio stays visible, including the licenses, languages and alerts beyond the free limits. You simply can no longer add licenses or languages beyond those limits; only three alerts stay active (the others are paused, not deleted); the value chart shows the last 3 months again (the older history is kept); and the graded population detail is no longer available. You can subscribe again at any time and find everything as it was.
14. Legal guarantees
As a consumer, you benefit from the legal guarantee of conformity for digital content and digital services (Articles L224-25-12 et seq. of the French Consumer Code) and from the legal guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code). Legal guarantee of conformity
The consumer is entitled to have the legal guarantee of conformity implemented if a lack of conformity appears during the whole supply period provided for in the contract, that is, for the duration of the subscription (each weekly, monthly or yearly period according to the plan, renewals included), from the supply of the digital content or digital service. During this period, the consumer only has to establish the existence of the lack of conformity, not the date on which it appeared.
The legal guarantee of conformity entails the obligation to provide all the updates necessary to keep the digital content or digital service in conformity for the duration of the subscription.
The legal guarantee of conformity gives the consumer the right to have the digital content or digital service brought into conformity without undue delay following the request, free of charge and without significant inconvenience.
The consumer may obtain a price reduction while keeping the digital content or digital service, or may terminate the contract and be fully refunded in exchange for giving up the digital content or digital service, if: (1) the trader refuses to bring the digital content or digital service into conformity; (2) bringing it into conformity is unjustifiably delayed; (3) it cannot be brought into conformity without costs imposed on the consumer; (4) bringing it into conformity causes significant inconvenience to the consumer; (5) the lack of conformity persists despite the trader's unsuccessful attempt to bring it into conformity.
The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to first request that the digital content or digital service be brought into conformity.
Where the lack of conformity is minor, the consumer is only entitled to cancellation of the contract if the contract does not provide for the payment of a price.
Any period during which the digital content or digital service is unavailable in order to be brought back into conformity suspends the remaining guarantee until the digital content or digital service is supplied in conformity again.
These rights result from the application of Articles L224-25-1 to L224-25-31 of the French Consumer Code.
A trader who in bad faith obstructs the implementation of the legal guarantee of conformity incurs a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (Article L242-18-1 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the digital content or digital service is kept, or to a full refund in exchange for giving it up.
15. Suspension or termination by us
If we terminate Premium or your account without any breach on your part, we give you at least 30 days' notice by email and refund the unused part of the period already paid, pro rata; for a subscription bought through a store, which only the store can refund, we reimburse that amount to you directly. If we suspend or close your account because you seriously breached the Terms of Use, the procedure described in section 8 of the Terms of Use applies.
16. Liability
Our liability is set out in section 9 of the Terms of Use. Nothing in these Terms of Sale limits your statutory rights as a consumer.
17. Personal data
We process the data needed to manage your subscription as described in the Privacy Policy. Paddle, Apple and Google process your payment data under their own privacy policies.

19. Mediation
If a written complaint sent to us has not been resolved to your satisfaction, you may refer the dispute free of charge to the consumer mediator CM2C, 49 rue de Ponthieu, 75008 Paris, France, phone +33 1 89 47 00 14, online at cm2c.net, within one year of your written complaint (Articles L612-1 et seq. of the French Consumer Code).
20. Governing law and jurisdiction
These Terms of Sale are governed by French law. If you are a consumer living in another country of the European Union, you also keep the protection of the mandatory provisions of the law of your country of residence. Disputes are brought before the competent courts; as a consumer, you may bring them before the courts of the place where you live.
