These Terms of Use (the “Terms”) govern your use of folio.fyi, meaning the website and the folio mobile app (the “Service”), published by Hugo Bonnet EI (entrepreneur individuel), 9 rue des Colonnes, 75002 Paris, France (“folio.fyi”, “we”). The publisher's full details are in the Legal Notice.
By using the Service, and in any case when you create an account, you accept these Terms. If you do not accept them, please do not use the Service.
1. The Service
folio.fyi is a price guide and collection tracker for trading card games and collectibles. It lets you catalog your collection and follow estimated market values computed from aggregated data. We are not a marketplace: we do not buy, sell or broker physical goods, and the prices shown are not offers to sell.
Most of the Service is free. Some optional features are part of a paid subscription, Premium, governed by the Terms of Sale.
2. Accounts
Some features, such as saving your collection, require an account.
- You must be at least 15 years old to create an account. Under 15, you need the agreement of a parent or guardian, who must also consent to the processing of your data (see the Privacy Policy).
- You agree to provide accurate information and to keep your login credentials confidential. Tell us without delay if you think someone else is using your account.
- Accounts must be created by a human. Accounts registered by bots or other automated means are not permitted.
- You can delete your account at any time (see the Privacy Policy).
3. Intellectual property
folio.fyi is an independent project. It is not affiliated with, endorsed or sponsored by The Pokémon Company, Nintendo, Creatures, GAME FREAK, Bandai, Disney, Ravensburger, Konami or any other trading card game publisher.
- Card images and names. Game names, character names, card names, card images and related marks are trademarks and copyrighted works of their respective owners. folio.fyi uses them only to identify the cards and products it lists and to inform collectors about them. If you hold rights in any of these elements and object to a use, write to contact@folio.fyi: we will review your request promptly and remove the content where appropriate.
- Our content. The design, code, logos and original content of folio.fyi (texts, descriptions, price computations) belong to Hugo Bonnet EI. The database is also protected by the rights described in section 10.
4. Market data and valuation (no financial advice)
One of our key features is displaying the estimated value of cards.
- Estimates only. Prices displayed on folio.fyi are estimates based on aggregated historical data from third-party sources. They may not reflect the exact current market price.
- Not financial advice. This information is provided for information and entertainment purposes only. It is not financial or investment advice, and it is not an offer to buy or sell. Your buying and selling decisions remain your own.
- Accuracy. We work to keep prices and card details accurate, but we cannot guarantee that they are free of errors. If you spot one, please tell us.
5. User conduct
You agree not to:
- Use the Service for any illegal purpose.
- Extract, copy, harvest or re-use, by any means whether automated or not, all or a substantial part of the Service's content, including pages, data, images, APIs and technical interfaces, or carry out repeated extractions of non-substantial parts.
- Overload our servers or interfere with the proper working of the Service.
- Choose a pseudonym, or use the public features of your profile, in a way that is unlawful, offensive, misleading or that infringes the rights of others.
6. Public profile and reporting
Your pseudonym, your avatar and statistics about your collection are shown on your public profile (see the Privacy Policy). You are responsible for the pseudonym you choose and the ratings you give. We may remove content that breaks the law or these Terms, or suspend the features concerned; we will tell you why, and you can contest the decision by writing to us.
To report content you believe is unlawful, write to contact@folio.fyi with the address of the page, an explanation of why the content is unlawful, and your name and email address. We process reports diligently and inform you of our decision.
8. Suspension and termination
- By you. You can stop using the Service and delete your account at any time. Deleting your account does not cancel a Premium subscription bought through the App Store or Google Play: cancel it first (see the Terms of Sale).
- By us, for a breach. If you seriously or repeatedly breach these Terms (for example fraud, automated extraction of the database, or attempts to disrupt the Service), we may suspend or close your account. Except in urgent cases (security of the Service or of its users, or a legal obligation), we will first notify you by email and give you the opportunity to explain yourself. We always tell you the reasons for our decision, and you can contest it by writing to us.
- By us, without any breach on your part. We may close the Service or your account for a legitimate reason, for example if we stop operating folio.fyi, with at least 30 days' notice by email. You can ask us to send you your collection data before the closure. If you are a Premium subscriber, we refund the unused part of your subscription period, pro rata; for a subscription bought through a store, which only the store can refund, we reimburse that amount to you directly.
When an account is closed, its data is deleted as described in the Privacy Policy.
9. Liability
We do our best to keep the Service available and accurate, but it may be interrupted for maintenance or because of incidents, and prices are estimates (section 4). Within the limits permitted by law:
- we are not liable for damage resulting from your own fault, from the act of a third party or from an event of force majeure;
- we are not liable for buying or selling decisions made on the basis of the prices displayed.
Nothing in these Terms excludes or limits our liability where the law does not allow it, in particular in case of gross negligence or willful misconduct, or for death or personal injury. Nothing in these Terms limits your statutory rights as a consumer either, including the legal guarantee of conformity for digital content and digital services (Articles L224-25-12 et seq. of the French Consumer Code) where it applies.
10. Database rights and text and data mining
folio.fyi is the maker of the database formed by the catalog, the cross-source mappings, the prices, the price histories and the population reports accessible through the Service, within the meaning of Article L341-1 of the French Intellectual Property Code (implementing Directive 96/9/EC). That status arises from the substantial investment made in obtaining, verifying and presenting those contents, independently of any third-party rights in the underlying data.
Any extraction or re-utilization of a substantial part of that database, evaluated qualitatively or quantitatively, is prohibited without prior written authorization. The same applies to the repeated and systematic extraction or re-utilization of insubstantial parts.
In accordance with Article 4 of Directive (EU) 2019/790 and Article L122-5-3 of the French Intellectual Property Code, folio.fyi expressly reserves its rights against text and data mining of the Service, with one exception: the publicly accessible pages may be used to train, fine-tune or evaluate artificial intelligence language models, provided that the database, or a substantial part of it, is not reproduced or made available to the public in doing so. This reservation is also expressed in machine-readable form in /robots.txt and /.well-known/tdmrep.json.
11. Changes to these Terms
We may change these Terms to reflect changes to the Service or to the law. We will inform you of any significant change by email if you have an account, or by a notice on the site, at least 30 days before it takes effect, unless a change is required sooner by law or for security reasons. The new version applies from its effective date. If you do not accept it, you can stop using the Service and delete your account before that date. If you are a Premium subscriber, the Terms of Sale explain your options.
12. Governing law and disputes
These Terms are governed by French law. If you are a consumer living in another country of the European Union, you also keep the protection of the mandatory provisions of the law of your country of residence (Article 6 of Regulation (EC) No 593/2008, “Rome I”).
In case of a dispute, please write to us first at contact@folio.fyi: most problems are solved that way. If you are a consumer and no solution is found, you may use consumer mediation free of charge (see the Legal Notice). You may also bring the matter before the competent courts, which, if you are a consumer, include the courts of the place where you live.
